What do you provide for the estate inventory?
A written broker opinion of value built from closed comparable sales and the rent roll. Where the court needs a formal appraisal, that comes from the probate referee or appraiser; our opinion supports the fiduciary's decisions.
Do you handle court-confirmed sales?
Yes. We market so the accepted offer can stand up to overbids at the hearing (at least 10% of the first $10,000 plus 5% of the rest, Prob. Code §10311) and meets the 90% appraisal rule (Prob. Code §10309). We provide the marketing record and offer history for the Report of Sale.
And IAEA full-authority sales?
Yes. We give you the final terms for the Notice of Proposed Action, which must go out at least 15 days before the sale (Prob. Code §10586), and hold the closing date open for the objection window (Prob. Code §10587).
Trust and conservatorship sales?
Trustees usually sell without court approval (Prob. Code §16200). Conservators generally need court authorization or confirmation unless granted independent powers (Prob. Code §2540, Prob. Code §2591). We adapt the process and paperwork to each.
How is the commission handled in probate?
In court-confirmed sales the court approves the commission, and the estate owes nothing unless the sale is confirmed and closes (Prob. Code §10160). Commissions are negotiated.
How fast do you respond to a referral?
Within one business day, by phone or email to you and, if you prefer, to your client.
